Expungement eligibility depends on the exact charge, disposition and criminal history. A dismissal, acquittal, misdemeanor and felony conviction can follow different Kentucky procedures.
Automatic expungement for qualifying acquittals and dismissals
Kentucky Court of Justice states that cases dismissed with prejudice or ending in acquittal on or after July 15, 2020 are automatically expunged after 30 days, excluding traffic cases. No defendant action is required for those qualifying cases.
The automatic expungement order is distributed to the defendant or attorney, prosecutor, Kentucky State Police, arresting agency and local jail. A defendant who needs another agency included must notify the court within the published 60-day period.
