Correct inaccurate information
Fix a wrong booking, charge or disposition
Identify which database is wrong
Compare the jail booking, Sheriff report, court docket and Georgia criminal history.
Save the inaccurate entry
Record the URL, date, booking ID, case number and disputed field.
Obtain the controlling proof
Use a certified disposition, amended judgment, dismissal order or written agency correction.
Send an arrest-data error to the arresting agency
The agency that submitted the arrest and identification data generally must authorize its correction.
Send a missing disposition to the court or prosecutor
The court or prosecutor can transmit the correct final disposition to GCIC.
Contact GCIC for your statewide record issue
Include the full name, birth date, race, sex, arrest date and available SID or OTN identifiers.
Recheck all systems
Updating GCIC may not automatically change a jail website or private background report.
Correction versus restriction: Correction fixes false or incomplete data. Record restriction limits ordinary disclosure of an accurate arrest that legally qualifies.
Georgia record restriction
Restrict an eligible Forsyth County arrest record
Georgia generally uses the term record restriction rather than expungement. The arrest information is not destroyed. It becomes unavailable to ordinary private background searches while remaining available to authorized judicial and criminal justice agencies.
Arrest on or after July 1, 2013
Contact the prosecutor that handled the case. There is generally no separate arresting-agency application process for these arrests.
Arrest before July 1, 2013
Begin with the arresting agency and complete the Request to Restrict Arrest Record application process.
Examples of outcomes that may qualify
Dismissed
Not presented to the grand jury
No further action anticipated
Nolle prosequi
Dead docket in a qualifying situation
No record on file after the appropriate review
A guilty disposition is generally not eligible for ordinary arrest-record restriction. Other Georgia relief, including First Offender treatment, may follow different rules.
Obtain your Georgia criminal history
Confirm that every Forsyth County charge shows the correct final disposition.
Obtain the court disposition
Request the dismissal, nolle prosequi, dead-docket entry or other final record from the Clerk.
Identify the arrest date
The July 1, 2013 division determines where the process begins.
For a newer arrest, contact the prosecutor
Contact the District Attorney for felony cases or the Solicitor-General for misdemeanor cases.
For an older arrest, contact the arresting agency
Complete Section One of the Request to Restrict Arrest Record form.
Allow agency and prosecutor review
The arresting agency completes its section and forwards the request for prosecutorial approval when required.
Submit the approved application when instructed
When the prosecutor cannot transmit the restriction electronically, send the approved paperwork and current $25 GCIC processing fee.
Keep the completion letter
Georgia states that GCIC generally processes a complete application in approximately two to three weeks.
Appeal a prosecutor denial on time
Georgia’s public instructions state that a denial may be appealed to the county Superior Court within 30 days.
Check the court file separately
GCIC restriction and sealing public court documents may require separate legal steps.
