When an Omaha criminal record can be sealed
Dismissed / not guilty after Dec. 31, 2016
Nebraska Judicial Branch states that qualifying cases dismissed or ending in acquittal after December 31, 2016 are sealed automatically.
Dismissed / not guilty before Jan. 1, 2017
A motion may be required to seal the record because the automatic process does not cover the older disposition in the same way.

Trafficking-related conviction
A person whose conviction resulted from being subjected to sex trafficking may have a set-aside and sealing route when statutory requirements are met.
Pardoned conviction
A conviction that has received a qualifying pardon may be eligible for a sealing request.
Juvenile records
Juvenile records follow a separate sealing system and should not be treated as ordinary adult criminal cases.

A set-aside is not deletion. Nebraska State Patrol states that Nebraska does not have a general statutory expungement process that simply deletes an accurate arrest or conviction. Expungement is generally associated with an arrest caused by law-enforcement error.
