Domestic-violence release rule

North Carolina does not impose an automatic 48-hour jail sentence after every qualifying domestic-violence arrest. For certain domestic-violence charges, only a judge may set conditions of release during the first 48 hours. If a judge has not acted within that period, a magistrate may then have authority under the applicable statute.

Why release can take time after bond

Cumberland County states that release staff conduct a comprehensive review of the inmate’s file. Releases can occur at any hour and may result from bond, a court order, sentence completion, payment of fine/costs, removal of another-agency hold or lawful transfer.
People serving a local sentence are generally discharged between 6:00 a.m. and 9:00 p.m. on the release day unless the court orders otherwise. Jail staff do not disclose security-sensitive transport times.

North Carolina Judicial Branch currently states that the general expunction petition filing fee is $175. Some statutes do not require the fee, including qualifying dismissed charges and not-guilty cases, unless the dismissal resulted from completion of a diversion program or deferred prosecution agreement.
