Trace a Fayetteville Arrest From Police Report to the Final Cumberland County Court Result

Fayetteville Police can make the arrest, but the City does not operate the jail. Current custody is handled by the Cumberland County Sheriff, while the criminal case moves through North Carolina District or Superior Court.

This guide connects those systems and explains recent police arrests, jail booking delays, incident reports, warrants, court searches, bond, release, visitation, scanned inmate mail, phone rules, Public Defender help, victim services, North Carolina criminal history and expunction.

Fayetteville Police provides a dedicated Recent Arrests page through Police-to-Citizen (P2C). It can be a fast first check when FPD made the arrest.

New arrest missing? Cumberland County explains that pre-booking at the arresting agency can take four hours or more, and the jail intake/booking process itself may take approximately four to eight hours. A very recent arrest may therefore be absent from the inmate database for several hours.

Arrest-to-court lifecycle

Follow a Fayetteville arrest all the way to disposition

Incident and investigation Fayetteville Police, Cumberland Sheriff or another agency creates the incident record.
Arrest / pre-booking The person can spend several hours with the arresting agency before arriving at the county jail.
County booking Detention staff perform medical and mental-health screening, identification, fingerprinting, warrant checks and clerical intake.
Initial appearance / release conditions A judicial official determines the authorized conditions of release and sets a court date.
District Court stage Most misdemeanor prosecutions are handled in District Court; felony matters also have early proceedings before Superior Court prosecution.
Superior Court felony case Felony prosecutions generally proceed in Superior Court after indictment or other lawful transfer.
Plea negotiations, motions or trial The ultimate charge can differ significantly from the arrest allegation.
Disposition and sentence Determine the outcome of every count: dismissal, acquittal, plea, conviction or another disposition.
SBI / NCDAC update Fingerprint-supported criminal-history and correctional systems can reflect later case and custody information.
Correction or expunction Fix inaccurate data or use an eligible North Carolina expunction statute after the case is resolved.

Case number Use the full Enterprise Justice number when known. Usually the strongest way to identify one specific case.
Party name Search defendant name, then filter by location and case type. Useful when the case number is unknown.
Wildcard name Portal permits wildcard searching using partial names with an asterisk under its search rules. Helpful for spelling variation.
Case status Filter or read the current case status. Separates pending cases from resolved matters.
Dispositions Review each count’s disposition. This is the key field for distinguishing arrest from conviction.

Bond and release

Confirm the judicial release condition before paying

Cumberland County states that bail is determined by a judicial official during intake. Bond can later be reviewed at a court hearing. Always verify the current order immediately before providing money or property.
Written promise

No money is paid in advance; the defendant promises to appear.

Custody release

A person or organization agrees to supervise the defendant and ensure court appearance.

Unsecured bond

No upfront payment, but money can become owed if the defendant fails to appear.

Secured bond

Money or qualifying security must be provided before release.

Confirm the release order with the Magistrate or jail Public Magistrate: 910-672-5610
Ask whether the bond is written promise, custody, unsecured or secured Do not assume that a dollar amount is required.
If using a professional bail bondsman, verify authorization North Carolina Judicial Branch publishes the current county-by-county authorized surety list. Find an authorized Cumberland County bondsman
Save the release paperwork and next court date Missing court can trigger bond forfeiture and another order for arrest.

Domestic-violence release rule

North Carolina does not impose an automatic 48-hour jail sentence after every qualifying domestic-violence arrest. For certain domestic-violence charges, only a judge may set conditions of release during the first 48 hours. If a judge has not acted within that period, a magistrate may then have authority under the applicable statute.

Why release can take time after bond

Cumberland County states that release staff conduct a comprehensive review of the inmate’s file. Releases can occur at any hour and may result from bond, a court order, sentence completion, payment of fine/costs, removal of another-agency hold or lawful transfer.
People serving a local sentence are generally discharged between 6:00 a.m. and 9:00 p.m. on the release day unless the court orders otherwise. Jail staff do not disclose security-sensitive transport times.

North Carolina record relief

Expunge an eligible Cumberland County arrest or conviction

North Carolina has many different expunction statutes. Eligibility depends on the exact disposition, offense, age at the time of offense, prior criminal history, waiting period and the specific statute used. Do not assume that all dismissed or old records use the same form.

Common expunction categories

Examples from the North Carolina Judicial Branch expunction framework
Record type Common statute / route Key point
Dismissed criminal charge G.S. 15A-146 Uses the dismissal expunction process when statutory requirements are met.
Not guilty / not responsible G.S. 15A-146(a2) Separate approved petition/instruction route.
Nonviolent misdemeanor conviction G.S. 15A-145.5 Eligibility, exclusions and waiting rules apply.
Nonviolent felony conviction G.S. 15A-145.5 Different conviction and waiting-period rules apply.
Certain drug matters G.S. 15A-145.2 Separate forms exist for qualifying drug dispositions/convictions.
Identity theft / mistaken identification G.S. 15A-147 Special relief exists for qualifying mistaken-identity cases.

Current filing-cost rule

North Carolina Judicial Branch currently states that the general expunction petition filing fee is $175. Some statutes do not require the fee, including qualifying dismissed charges and not-guilty cases, unless the dismissal resulted from completion of a diversion program or deferred prosecution agreement.
Search every Cumberland County case first Record the case number, charge and final disposition.
Identify the exact expunction statute Do not choose a form simply because its title looks similar.
Open the current North Carolina expunction guide Open NC Expunctions
Download the current approved AOC form and instructions North Carolina provides separate forms for different expunction statutes. Search current expunction forms
Complete required attachments and affidavits Some petitions require additional character affidavits, record checks or other supporting documents.
File in the county where you were charged or convicted For a qualifying Cumberland County matter, file with the Cumberland County Clerk of Superior Court.
Determine whether the $175 filing fee applies Do not pay it if the applicable statute provides a fee-free route.
Use the indigency procedure if necessary North Carolina permits an applicant who cannot afford the filing fee to request permission to proceed without prepaying it.
Attend a hearing if the court schedules one Some expunction types require judicial findings that may involve a hearing.
Keep your expunction order immediately The Judicial Branch warns that the ordinary expunction file, including the order, is later destroyed from the clerk’s criminal-process records.
Recheck government sources after processing If a North Carolina court-system source still displays the case several weeks later, contact the Clerk where the expunction was granted.
Keep the signed order. North Carolina states that after the expunction process is completed, you ordinarily cannot later obtain another copy of the original order from the destroyed criminal-process file. For qualifying petitions filed on or after December 1, 2017, a separate verification certificate process is available through the Administrative Office of the Courts.
