Current Chesterfield expungement rules change on December 1, 2026
Date matters. Virginia Code §19.2-392.2 has one version in effect through November 30, 2026 and a revised version effective December 1, 2026.
Rules in effect on August 17, 2026
Under the version currently in effect, a person charged with an offense may petition for expungement when the person is acquitted, when a nolle prosequi is taken, or when the charge is otherwise dismissed, including qualifying accord-and-satisfaction dismissals. No court filing fee or cost is required for a petition under that subsection.

Change effective December 1, 2026
Beginning December 1, 2026, §19.2-392.2 is revised to cover a person who was arrested, charged, summonsed or indicted and was not ultimately convicted, provided there was no stipulated or judicial finding of facts sufficient for guilt followed by deferred adjudication or disposition. The revised law also allows a single petition to include qualifying charges arising from separate transactions.
Chesterfield Police states that people petitioning for a court-ordered expungement should have fingerprints taken by the Police Records Section after filing the petition and receiving a copy of the charge and disposition.
Virginia sealing now covers more than traditional expungement
Virginia Chapter 23.2 provides both automatic sealing and petition-based sealing. Sealing generally prohibits ordinary public access to covered criminal-history and court records while preserving authorized governmental access.

Current law automatically seals certain eligible acquittals, dismissals and specified qualifying convictions under the statutory process.
Petition-based sealing
Virginia Code §19.2-392.12 allows petitions for certain misdemeanor, Class 5 or 6 felony, qualifying larceny felony and deferred-dismissed records, subject to extensive eligibility limits.

Not every offense is sealable. Current Virginia law contains a long list of exclusions, including various violent, sexual, domestic-violence, DUI, protective-order, firearm-related and other offenses.
A sealed record is not erased for every purpose. Virginia law preserves specified government access and requires disclosure in certain situations.
