Understand Danville expungement versus Virginia record sealing

Virginia now has both expungement and a broader criminal-record sealing framework. They are not interchangeable. Eligibility depends on the exact disposition, offense and statutory route.

Traditional expungement

As of August 2026, Virginia Code §19.2-392.2 still allows qualifying people whose charges resulted in acquittal, nolle prosequi or another qualifying dismissal to petition the Circuit Court for expungement.

  • No court filing fee or court costs are required for the qualifying petition described by the statute.
  • The Commonwealth’s Attorney receives the petition.
  • Virginia State Police / CCRE criminal-history information becomes part of the process.

Virginia criminal-record sealing

Virginia’s newer Chapter 23.2 now provides automatic and petition-based sealing for qualifying records.

  • Certain misdemeanor acquittals or dismissals with prejudice can be automatically sealed.
  • Certain felony acquittals/dismissals may be sealed after an immediate request and prosecutor concurrence.
  • Specified convictions can qualify for automatic sealing.
  • Some misdemeanors, Class 5 or 6 felonies and qualifying larceny offenses can be petitioned for sealing.
