Georgia record restriction
Use the arrest date to choose the correct Georgia restriction process
Georgia commonly calls this process record restriction. It limits ordinary non-criminal-justice access to qualifying arrest information; it does not physically destroy the record or erase every copy held by private sources.
Arrest before July 1, 2013
Start with the arresting agency and use the GBI Request to Restrict Arrest Record form.
- One arrest date per form.
- You complete Section 1.
- Arresting agency completes Section 2.
- Prosecutor completes Section 3.
DATE
TEST
Arrest on/after July 1, 2013
Contact the prosecuting attorney directly. GBI states there is no old-style arresting-agency application process for these arrests.
- Misdemeanor: contact the appropriate Solicitor-General.
- Felony: contact the appropriate District Attorney.
- Prosecutor evaluates statutory eligibility.

The GBI’s current official restriction-form instructions state that the arresting agency may charge a processing fee of up to $50 for qualifying pre-July 2013 requests.
If an approved pre-2013 application must be sent by the applicant to GCIC because the prosecutor did not enter the restriction electronically, the current GBI form instructs the applicant to include a $25 GCIC processing fee by money order or certified check payable to Georgia Bureau of Investigation.

Allow the prosecutor to decide eligibility
Georgia’s current statewide guide says the prosecutor generally approves or denies the request within 90 days.
If approved, confirm transmission to GCIC
The prosecutor may transmit the approved restriction through the state system.
If you must mail it yourself, use the approved application and required GCIC payment
Do not mail a denied or incomplete application to GCIC.
Allow GCIC processing time
Georgia’s June 2026 guide says complete restriction applications are usually processed within approximately 2–3 weeks.
Keep the completion letter
GCIC sends written confirmation when the restriction has been applied.
Examples of dispositions commonly associated with restriction review
Dismissed
Not presented to grand jury
No further action anticipated
Nolle prosequi
Dead docket
No record on file in qualifying circumstances
Some Georgia misdemeanor or First Offender situations involve additional rules beyond the ordinary non-conviction restriction pathway. Do not assume every guilty disposition can be handled using the basic arrest-restriction form.
